I. Terms and Conditions

A. Website

The Full Pedal Website (“Website”) and Mobile application (“App”) allows users to receive information about the studio(s), reserve, pay and cancel services, and track performance. The services (“Full Pedal Services”) offered by Full Pedal include all services at the studios, on the Website and App. As a user of the Full Pedal Services, you agree to be bound by these Terms, whether you are a “Visitor” (you browse the Website or App) or you are a “Customer” (you have registered with Full Pedal and/or purchased one or more Full Pedal Services). You are only authorized to use the Full Pedal Services if you agree to abide by these Terms. By accessing this website whether through your personal computer, mobile device or otherwise, you signify your agreement to these Terms. If you do not agree to any of these Terms you are not authorized to use the Website or App. If you wish to register, you must read these Terms and indicate your acceptance during the registration process. Full Pedal may, in its sole discretion, modify or revise the Terms at any time, and you agree to periodically check the Terms and be bound by such modifications or revisions. If you use the Website or App, you are responsible for maintaining the confidentiality of your account and agree to accept the responsibility for ALL activities that occur under your account.

B. Waiver and Release

It is strongly recommended you consult and receive approval from your physician before trying indoor cycling. You acknowledge that if you have any chronic disabilities or conditions, you are at risk in using Full Pedal Services, and should not be participating in any classes. By signing up for and/or attending classes, events, activities, and using the premises, facilities and equipment (individually and/or collectively, the “Full Pedal Services”) of Full Pedal, you hereby acknowledge on behalf of yourself, your personal representatives, heirs, and/or assigns, that there are certain inherent risks and dangers in indoor cycling and exercise equipment in association with the Full Pedal Services. You acknowledge that some of these risks cannot be eliminated regardless of the care taken to avoid injuries. You also acknowledge that the specific risks vary from one activity to another, but range from (1) minor injuries such as bruises, scrapes, and sprains; (2) major injuries such as back or joint injuries, heart attacks, concussions and vision impairment; and (3) catastrophic injuries including paralysis and death. At all times, you shall comply with all stated and customary terms, posted safety signs, rules, and verbal instructions given to you by instructors and staff. You hereby acknowledge that if in Full Pedal’s subjective opinion, you would be at physical risk by participating in any Full Pedal Services, you may be denied access to the Full Pedal Services. If you wish to contend this opinion you may submit a letter from your doctor, clearing you for the Full Pedal Services you wish to enroll. Furthermore, in consideration of being allowed to participate in and access the Full Pedal Services, you hereby (1) agree to assume FULL responsibility for any and all injuries or damage which are sustained or aggravated by you in relation to the Full Pedal Services, (2) release, indemnify, and hold harmless Full Pedal, its parent, subsidiary affiliate entities, and its owners, officers, directors, members, representatives and agents, employees and each of their respective successors and all others, from any and all responsibility, claims, actions, suits, procedures, damages, expenses, costs, and liabilities to the fullest extent allowed by law arising out of or in any way related to participation in the Full Pedal Services including the classes or use of the facilities, and (3) represent that you (a) have no medical or physical condition that would prevent you from properly using any of Full Pedal’s Services and facilities, (b) do not have a physical or mental condition that would put you in any physical or medical danger, and (c) have not been instructed by a physician to not participate in physical exercise. You acknowledge you have read and thoroughly understand the Full Pedal Bike Safety Instructions that are posted on Full Pedal’s website (www.fullpedal.com), and will have requested, should you not have received, a hard copy provided by Full Pedal staff in person at the studio.

C. Unsupervised Kids Area: Waiver and Release:

As part of the Full Pedal Services, the Unsupervised Kids Area is available for parents/guardians desiring to leave their children unsupervised. It is strongly recommended prior to leaving your child, you inspect the unsupervised area and the other children present. You acknowledge by placing your child in an unsupervised area your child is at risk and will not have adult supervision. By placing your child into such area, you hereby acknowledge on behalf of yourself, your personal representatives, heirs, and/or assigns, that there are certain inherent risks and dangers in association with leaving a child unsupervised. You acknowledge that some of these risks cannot be eliminated regardless of the care taken to avoid injuries or damage. You also acknowledge that the specific risks range from (1) minor injuries to the child such as bruises, cuts, scrapes, and sprains; (2) major injuries such as broken bones, joint injuries, concussions and vision impairment; and (3) catastrophic injuries including paralysis or death resulting from actions such as choking, wandering out of the premises. At all times, you and your child shall comply with all stated and customary terms, posted safety signs, rules, and verbal instructions given to you by instructors and staff. You hereby acknowledge that if in Full Pedal’s subjective opinion, your child would be at risk or put others at risk, the child may be denied access to the Full Pedal Services. Furthermore, in consideration of being allowed to participate in and access the Full Pedal Services, you hereby (1) agree to assume FULL responsibility for any and all injuries or damage which are sustained or aggravated by your child while your child is on the premises, outside the facility, or in the parking area, (2) release, indemnify, and hold harmless Full Pedal, its parent, subsidiary affiliate entities, and its owners, officers, directors, members, representatives and agents, employees and each of their respective successors and all others, from any and all responsibility, claims, actions, suits, procedures, damages, expenses, costs, and liabilities to the fullest extent allowed by law arising out of or in any way related to participation in the Full Pedal Services including the Unsupervised Kids Area or use of the facilities, and (3) represent that your child (a) has no medical or physical condition that would prevent him/her from being unsupervised, (b) do not have a physical or mental condition that would put the child or others, in any physical or medical danger, and (c) have not been instructed by a physician or aware of any conditions that would put your child at risk while unsupervised. You acknowledge you have read and thoroughly understand the Unsupervised Kids Area Rules and assume all risk associated.

II. General Terms

A. Use of Site by Minors

You must be at least 11 years of age, and meet the minimum height requirement of 4’11” to register for Full Pedal Services. If you are a Minor (under the age of 18), you may register on the Website or App but will need the involvement of a parent or guardian. The acknowledgment and acceptance of these terms and conditions must be signed by the parent or guardian. Once this process is fulfilled, a Minor may use the Website or App to reserve, pay and cancel classes. If it is determined a minor registered and did not fulfill the above requirement, Full Pedal reserves the right at its sole discretion to delete the registration information and account, and ban minor from any and all Full Pedal Services. We do not share the information of Minors.

B. Reservations/Classes/Payment

Reservation – You must have an account and a single class or series to make a reservation. You should be aware that classes and series expire, and future prices are subject to change. You cannot redeem your class for cash and you cannot transfer it to another rider or member. You can reserve classes online no later than 15 minutes prior to class start time.

Classes Expire – Expiration dates are posted in the description of the class or class cards on the Website and the App.

Payment – Your card will be charged when you purchase a class or series or make your reservation. We accept MasterCard, Visa, and American Express. Cash payments may only be made at the studio. If you fail to pay any fees or charges when due, your services or privileges may be suspended or terminated. You will be fully responsible and liable for any fees and collection costs that Full Pedal may incur in its efforts to collect any unpaid balances from you.

C. Membership

Premium Membership – Premium membership is a recurring charge package. Premium membership will continue to auto-renew at the same rate and date each month, and you understand that if you received the $60 introductory month, that was for the FIRST MONTH ONLY and the regular rate will begin on the second month. You acknowledge that you can cancel at anytime, by submitting the Auto-Renew Contract Termination Form at the Full Pedal front desk 48 hours before the date of the next billing cycle. You agree to allow Full Pedal to charge your credit card on a monthly basis for your membership under the terms and conditions of your Membership Agreement. You agree to inform Full Pedal of any change in your credit card information within 5 days of the next billing cycle. (i.e. billing address, expiration date, etc), by emailing info@drewk157.sg-host.com. You understand that you can freeze your auto-renew payment for up to 3-months per year with a written request to info@drewk157.sg-host.com.

D. Cancellations

Premium Membership CancellationThe Contract Termination Form (CTF) must be submitted to the front desk 48 hours before the date of the next billing cycle, which is set the date of member enrollment/member specification. The CTF can be obtained at the front desk at any Full Pedal location.

We do not accept membership cancellations via phone or email.

Cancellation Policy – In order to cancel a Full Pedal class and return it to your account, you must UNRESERVE 10 hours prior to the class start time. Once canceled (not refunded), the class will be returned to your account to be used at a future date. If you haven’t canceled your bike 10 hours prior to the class start time, your scheduled class will be charged to your series. If you are an Unlimited member, you will be charged $9.00. You can cancel your reservation by logging into your account and UNRESERVING your reservation.

To cancel your reservation:

  1. Log into your account on the Website or the App.
  2. Select “My Classes” (you will see a list of your classes)
  3. Select which class you wish to cancel.
  4. Select the gear ⚙️ under the heading “Action” next to the class you would like to cancel and select cancel.

We do not accept class cancellations via email or phone messages.

III. Studio Policies

A. Indoor Cycling Shoes

We require SPD indoor -cycling shoes to be worn in order to ride in a class at Full Pedal. You can bring your own shoes, or you can rent a pair of ours for $2 each ride (first ride comes with a free shoe rental). Rental shoes must be returned to the shoe drop immediately following class, or your credit card will be charged $50 to cover the cost of shoe replacement.

B. No Show Fees

Bikes will be released 2 MINUTES prior to class starting, UNLESS the rider has called the studio and spoke to the front desk, communicating their timing.

C. For Riders Running Late

Please call the studio, as early as possible, to let the front desk know you are on the way. The front desk will hold a reservation for up to 5 minutes (“5-Minute Rule”) after class begins though we cannot guarantee you will be given the bike you signed up for. Riders who are more than 5 minutes late will not be admitted into class. If you are not here 5 minutes before class, your seat may be given away to another rider and you will forfeit your class. This is for the courtesy of the instructor and other clients.

D. For Riders Leaving Early

Please avoid leaving class early as it is a distraction to fellow riders and the instructor. If you absolutely MUST leave class early, please tell the instructor ahead of time.

E. Sold-Out Classes/Walk-Ins

The 5-Minute Rule does not apply to sold-out classes. Open bikes will be given away to standbys 2-minutes prior to class starting. Please understand that if you are late and have a reservation, you may lose your spot.

F. Waitlist

If the class you want to attend is sold out, please put yourself on the waitlist. If there are cancellations, you will automatically be added to the class. Your best bet is to just SHOW UP! There are usually last minute no-shows. If you are on the waitlist and do not get a bike in the class, your class credit will be returned to your account to be used at another time. There are no refunds issued. If a bike opens up BEFORE our 10-hour cancellation window closes, members from the waitlist are AUTOMATICALLY added to the class. If a bike opens up AFTER the 10-hour cancellation window, the system will not automatically place you. We will try to call/text you, or you can call the studio to reserve the bike. If you put yourself on the waitlist, we assume you want to take the class. If you are automatically enrolled from the waitlist, you are now considered a rider in that class and our standard cancellation policy now applies. While we appreciate and understand the desire to secure yourself a spot in one class while being waitlisted for another, please know that we do not offer the option of swapping classes. If you end up enrolled in both classes, you will be charged for both classes.

G. No Cellphones In Pedal Room

Please be respectful.

H. Return Policy

All series sales are final, no refunds for cash or credit will be provided after the purchase of a series. If you choose not to continue your series you are not eligible for a refund.

I. Security Statement

We are concerned about safeguarding the confidentiality of your information and take this very seriously. We make every effort to ensure that all of the transactions that occur on the Website and Appare secure. All credit card numbers and transactions are encrypted using 128-bit SSL encryption. Please be aware that, although we endeavor to provide reasonable security for information we process and maintain, no security system can prevent all potential security breaches.

J. How a Secure Connection Works

SSL (Secure Socket Layer) encryption makes it very difficult for anyone to intercept or decode messages exchanged over this type of secure connection. Any data that is transferred over the secure connection established between your browser and a website will be encrypted to prevent it from being viewed by any third parties. Internet browsers such as Chrome, Explorer, and Safari display an image of a locked padlock on their status bar or highlight the status bar a different color when connected to a secure site. Secure transactions are also indicated when the prefix in the location bar of your browser switches from http:// to https://, with the additional ‘s’ representing ‘secure’ and a secure connection to the Full Pedal website. If any of the above SSL indicators are missing then any data exchanged with the website may be visible to others.For more information on how your software establishes a secure connection, contact your browsers.

K. Information Collected Automatically

The information collected by the Website and App is anonymous information about users and does not contain anything that can identify individuals personally, such as a home or email address. This information allows Full Pedal to provide an optimal experience and better service throughout the web and mobile offerings helping us monitor how individuals use the Website and App.

L. User Provided Information

Full Pedal collects personal information about individuals – such as names, date of birth, zip codes, home addresses, and email addresses – ONLY when such information is provided to Full Pedal. Full Pedal may use this information to contact you with promotions, important information and notices, and provide you with performance tracking data should you elect. Personal information might be obtained from online transactions such as class/series purchases, retail purchases, and/or class registrations. Additionally, personal information may be transmitted as part of a form submission or in connection with other activities or services made available on the Website or App.

M. How Your Information Is Used

If you indicate that you are interested in receiving Full Pedal related news and information during registration, you may receive emails to the email address you provided as part of the registration process. If you purchase a series or sign up for a class the required personal information (similar to that provided during a telephone or mail order purchase) will be used to complete your order.

Full Pedal reserves the right to refuse service, terminate accounts, remove or edit content, or cancel orders, at its sole discretion. You can help us maintain the accuracy of your personal information by updating anytime you change your address, phone number, or email address. Full Pedal will NEVER rent, sell, or share telephone numbers, email addresses, or any personal data with third parties.

N. Photo Consent and Release

Without expectation of compensation or other remuneration, now or in the future, you hereby give your consent to Full Pedal to use your image and likeness and/or any interview statements from you in its publications, advertising or other media activities (including the Internet). This consent includes, but is not limited to:

*Permission to interview, film, photograph, tape, or otherwise make a video reproduction of me and/or record your voice;
*Permission to use your name; and
*Permission to use quotes from the interview(s) (or excerpts of such quotes), the film, photograph(s), tape(s) or reproduction(s) of you, and/or recording of your voice, in part or in whole, in its publications, advertising and other marketing media, on television, radio, and electronic media (including the internet, the Website, and App).

This consent is given in perpetuity and does not require prior approval by you.

O. Links/Third Party Websites

The Full Pedal Website or App may contain links to third party websites. Going to these is at your own risk. These links do not imply affiliation, endorsement of, or Full Pedal sponsorship. Although a third party website may contain the Full Pedal logo, Full Pedal has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third party websites, including privacy and data gathering practices. In addition, Full Pedal will not and cannot censor or edit the content of any third party site. By using the Full Pedal website, you expressly relieve and release Full Pedal from any and all liability arising from your use of any third party website.

In no event will Full Pedal be liable for any direct, indirect, special, or other consequential damages resulting from your use of the Website, the App, or on any other linked/third-party website.

P. Intellectual Property Rights

Through your sole use of purchasing classes, making reservations, checking personal performance, or other personal use you have the right to view, electronically copy and print hard copy portions of the Website and App. Full Pedal content, logos, design, and graphics are the property of Full Pedal and may not be used by you for any reasons other than as expressly permitted by these terms. All Website and App content, text, software, graphics and associated design are the exclusive property ofFull Pedal. Any other use of the content and materials of the Website and App, including modification, reproduction and/or distribution for purposes other than those noted above, without the prior written permission of Full Pedal, is strictly prohibited. Full Pedal may, in its sole discretion, discontinue or remove the Website or App, or any portion thereof, or discontinue your right to use the Website or App, or any portion thereof, at any time.

You acknowledge that Full Pedal and/or third party content providers remain the owners of all Website and App content, and that you do not acquire any of those ownership rights by downloading, utilizing, or copying any such material in accordance with these Terms.

Q. Commercial Use Of Website and App

Any unauthorized use of any material based upon Full Pedal’s Website and App is strictly prohibited. You are not authorized to create, reproduce, make commercial use, and/or distribute any materials derived from the content provided on the Website or App. Full Pedal’s material may not be displayed or communicated on any other website, in a networked computer environment or other digital support for ANY purpose whatsoever.

R. Venue and Jurisdiction

The Website and App, and your use hereof, is governed by the laws of the State of Nevada, without respect to its conflict of laws principles. Any claim arising out of your use of the Full Pedal Services must be brought in Nevada.
